1. Acceptance of Terms
By accessing or using Smart MAI's website or services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site. These terms apply to all visitors, users, and clients.
2. Services Description
Smart MAI provides AI-powered growth acceleration services, including market intelligence, autonomous lead generation, offer creation systems, pipeline management, and AI SDR operations. Our 90-day AI Accelerator program builds complete growth systems using autonomous AI agents tailored to your business model and buyer profiles.
3. Engagement and Payment
Engagement with Smart MAI services is governed by a separate Service Agreement signed between Smart MAI and the client. Payment terms, project scope, deliverables, and timelines are specified in that agreement. All fees are non-refundable unless otherwise stated in the Service Agreement. Smart MAI reserves the right to suspend services for non-payment.
4. Intellectual Property
Smart MAI retains ownership of all proprietary AI systems, methodologies, frameworks, and technology developed by Smart MAI. Upon full payment, clients receive a license to use the growth systems, campaign assets, and materials created specifically for their engagement. Clients may not resell, sublicense, or redistribute Smart MAI's proprietary tools or methodologies.
5. Confidentiality
Both parties agree to maintain the confidentiality of proprietary information shared during the engagement. Smart MAI will not disclose client business information, strategies, or data to third parties without written consent, except as required by law or to perform the contracted services.
6. Limitation of Liability
Smart MAI's services are provided on an 'as is' basis. While we commit to deploying best-in-class AI systems and strategies, we do not guarantee specific revenue outcomes or closed deal volumes. In no event shall Smart MAI be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with our services, exceeding the total fees paid by the client in the preceding 90 days.
7. Governing Law
These Terms of Service shall be governed by and construed in accordance with applicable law. Any disputes arising under these terms shall be resolved through binding arbitration. Smart MAI reserves the right to update these terms at any time, with notice provided via email or website posting.
